Privacy Policy

This Privacy Policy explains how Motorsport Electronics Ltd ("we", "us", "our") collects, uses, stores and discloses the personal information you give us through this website. It forms part of our Terms & Conditions.

We handle personal information in accordance with the Privacy Act 2020 (New Zealand) and the Information Privacy Principles.

1.1 We have an appointed Privacy Officer, as required by section 201 of the Privacy Act 2020. The Privacy Officer is responsible for making sure we meet our privacy obligations and for dealing with any request or complaint about your personal information.

2. WHAT WE COLLECT

Information you give us

2.1 When you create an account, place an order, request a quote, submit a return or warranty claim, subscribe to our newsletter or contact us through this website, we may collect your name, billing and delivery address, email address, landline and mobile phone numbers, company name, order history, and any information you include in your message to us. Where you give us details of your vehicle or your project so that we can help you choose or configure a product, we record those details against your customer record so that we can support you properly next time.

Payment information

2.2 We do not collect, store or process full credit or debit card numbers. All card payments, including payments made using Apple Pay and Google Wallet, are made through the secure payment page provided by our payment provider, who collect and hold those details under their own terms and security standards. Payments made using PayPal or Afterpay are handled by those providers under their own terms and privacy policies, and you will see their name when you choose them at checkout. The name shown on your card statement for card payments will be Motorsport Electronics.

Information collected automatically

2.3 When you visit this website we collect technical information including your IP address, approximate location, browser type and version, device type, operating system, referring website, the pages you view, and the date and time of your visit. This is collected through cookies and similar technologies, described in section 5.

3. HOW WE USE YOUR INFORMATION

3.1 We use your personal information to:

  • process, fulfil, ship and invoice your orders;
  • send you delivery notifications by email and text message, and allow our couriers to do the same;
  • communicate with you about your order, including backorder notifications, shipping confirmations, returns and warranty claims;
  • answer your enquiries and provide technical and sales support;
  • manage your account and any trade credit arrangements;
  • send you marketing communications, and allow you to opt out at any time;
  • understand how this website is used so we can improve it;
  • detect and prevent fraud and misuse of this website; and
  • meet our legal, tax and record-keeping obligations.

4. EMAIL FROM US

Transactional email

4.1 Transactional email is sent from notifications@msel.com. This covers order confirmations, shipping and delivery notices, backorder updates, returns and warranty correspondence, and account notices. You cannot unsubscribe from transactional email about an order you have placed, because we need it to fulfil your order.

Marketing email

4.2 Marketing email is sent from sales@msel.com using our email marketing provider, which stores your email address and engagement data on our behalf, outside New Zealand. We send marketing email to people who have subscribed, and to our existing customers where the message relates to products or services similar to those they have bought from us.

4.3 Every marketing email contains a clear, one-click unsubscribe link. You may also unsubscribe at any time by emailing privacy@msel.com. Unsubscribing from marketing does not stop transactional email.

4.4 If you unsubscribe, we keep your email address on a do-not-contact list indefinitely. We do this so that we do not email you again by mistake, and we do not use that list for any other purpose.

4.5 We do not send marketing by text message. We only use your mobile number for delivery notifications, as set out in clause 6.2.

5. COOKIES, ANALYTICS AND YOUR PREFERENCES

5.1 Cookies are small files placed on your device. You can set your preferences at any time using the Manage Website Data Collection Preferences link in the footer of this website, or block and delete cookies through your browser settings. We group data collection into the four categories below.

Essential

5.2 Required for the website and any service you request to work. These keep your shopping cart, your selected country and your saved cookie preferences working. We also use Google reCAPTCHA to tell real visitors from automated traffic and protect our forms from abuse. reCAPTCHA collects hardware and software information from your device and analyses how you interact with our forms, and its use is subject to the Google Privacy Policy and Terms of Service. Essential cookies cannot be switched off, and the website will not function correctly without them.

Functional

5.3 Enable enhanced features such as embedded video, product reviews and ratings. We use a third-party reviews provider to invite reviews after a purchase and to display them. If you choose to leave a review, the name you supply and the content of your review are published on this website and can be seen by anyone.

Analytics

5.4 Provide statistical information about how this website is used so that we can improve it. We use:

  • Google Analytics, which measures visitor numbers, traffic sources and the pages you view. Google processes this data outside New Zealand.
  • A product analytics provider, which records your visit so that we can replay it and see how people move through the site. The recording captures your clicks, mouse movement, scrolling and the pages you view. It stores a pseudonymous identifier in a cookie so that repeat visits from the same browser are linked together, and processes this data outside New Zealand.
  • Microsoft Clarity, which also records your visit so that we can replay it and find usability problems. This is more than a record of where you clicked. Clarity captures your clicks, mouse movement, scrolling, window resizing, text selection and input events, together with the structure and visible content of the pages you view, and any script or performance errors. It stores a pseudonymous identifier in a cookie so that repeat visits from the same browser are linked together. It derives your approximate location from your IP address and masks the IP address before storing it, and it masks privacy-sensitive fields so that what you type into them is not captured. Microsoft holds these recordings for up to 30 days.

Targeting and advertising

5.5 Used to measure our advertising and to show you relevant content. We use the Meta (Facebook) Pixel, which tells Meta that you visited this website and which pages or products you viewed, so that we can measure our advertising and show ads to people who have visited us. Meta processes this data outside New Zealand and uses it for its own purposes under its own privacy policy. We may also use Google Ads, including remarketing, which allows Google to show our ads to you on other websites based on your visit to ours.

5.6 If you opt out of a category, we stop setting the cookies in that category. Some information may still be collected by your browser, or by services you interact with directly such as a payment provider.

6. WHO WE SHARE YOUR INFORMATION WITH

6.1 We do not sell your personal information.

6.2 We share your personal information only with:

  • Couriers and freight partners, who receive your name, delivery address, email address and mobile phone number so that they can deliver your order and send you delivery notifications by text and email. These are New Zealand Couriers, New Zealand Post, Uber and DHL. We use a shipping management platform to consolidate our New Zealand shipping, and your delivery details pass through that platform to the courier;
  • Our payment providers, in order to process your payment and any refund. You will see which provider is handling your payment when you reach the payment step at checkout;
  • Our email marketing provider, where you receive marketing email from us;
  • Our reviews provider, which receives your name, email address and order details so that it can invite you to review what you bought;
  • Our website and analytics providers, as described in section 5;
  • Manufacturers and suppliers, where necessary to process a warranty claim or a special order on your behalf. This may include sending your contact details and the product details to a manufacturer overseas;
  • Our accountants, auditors and professional advisers, where required; and
  • The police, a regulator, a government agency or a court, where we are required by law or by court order to do so.

6.3 Storage and overseas transfer. Our systems are managed in house and your records are held by us in New Zealand. We back those records up to third-party backup services, some of which store data outside New Zealand. Several of the service providers listed above also process or store data outside New Zealand. Where information is held overseas, we take reasonable steps to ensure it is subject to privacy safeguards comparable to those in the Privacy Act 2020.

7. HOW LONG WE KEEP IT

7.1 We keep order, invoice and tax records for at least 7 years from the end of the financial year to which they relate, as required by the Tax Administration Act 1994 and the Companies Act 1993.

7.2 We keep account records for 7 years from your last transaction with us, so that they align with our tax records.

7.3 We keep marketing records for as long as you remain subscribed or an active customer, and for 24 months after you unsubscribe or become inactive, after which they are deleted.

7.4 As set out in clause 4.4, we keep unsubscribe and do-not-contact records indefinitely so that we can honour your opt out.

7.5 Analytics and session recording data is held by the relevant provider for that provider's own retention period, which for Microsoft Clarity is 30 days.

7.6 We do not keep personal information for longer than is required for a purpose for which it may lawfully be used.

8. SECURITY

8.1 We take reasonable technical and organisational steps to protect your personal information against loss, misuse and unauthorised access. Data sent to and from this website, including at checkout, is encrypted in transit.

8.2 We are a small team, and because of the nature of our business every member of our team needs to be able to see customer and order records in order to do their job. Everyone who works for us is required to keep that information confidential and to use it only for the purposes set out in this policy.

8.3 No transmission over the internet can be guaranteed as completely secure. You send information to us at your own risk, and you are responsible for keeping your account password confidential.

8.4 If we have a privacy breach that has caused, or is likely to cause, serious harm, we will notify you and the Office of the Privacy Commissioner as required by the Privacy Act 2020.

9. YOUR RIGHTS

9.1 Under the Privacy Act 2020 you have the right to ask us for a copy of the personal information we hold about you, and to ask us to correct it if it is wrong.

9.2 To make a request, email our Privacy Officer at privacy@msel.com. We will respond within 20 working days. We may ask you to verify your identity before releasing information.

9.3 If you are not satisfied with how we have handled your personal information or your request, you may complain to the Office of the Privacy Commissioner at www.privacy.org.nz or on 0800 803 909.

10. CHILDREN

10.1 This website is not directed at children and we do not knowingly collect personal information from anyone under 16. If you believe we have, please contact privacy@msel.com and we will delete it.

11. THIRD PARTY SITES

11.1 This website may link to third-party sites. We are not responsible for their privacy practices. Please read their privacy policies before providing them with your information.

12. CHANGES TO THIS POLICY

12.1 We may update this Privacy Policy from time to time. The current version will always be published on this page, with the date it was last updated shown below. Continued use of this website after a change means you accept the updated policy.
